1. Scope of Service & Diagnostic Disclaimer

cognis11.com provides AI-powered verbal diagnostic frameworks, adaptive thought-trace analytics, and reasoning evaluation software designed strictly for parent-guided 11+ preparation and home review.

Educational Disclaimer: Our services are diagnostic and analytical tools. We make no guarantees, warranties, or representations regarding specific examination scores, grammar school admissions, independent school offer outcomes, or regional exam board benchmarks (GL Assessment, CSSE, SET, or equivalent).

2. Parental Responsibility & Age Gate

In compliance with global child data protection frameworks (including COPPA and UK GDPR):

• Accounts must be registered, managed, and authorized strictly by a parent, legal guardian, or authorized tutor who is at least 18 years of age.
• By initiating a diagnostic assessment, the account holder certifies that they are the parent or legal guardian giving explicit consent for the student to interact with the verbal reasoning interface.
• Parents are solely responsible for maintaining the security of their login credentials and account security controls.

3. Diagnostic Passes, Billing & Stripe Processing

Payments, diagnostic credits ("Passes"), and account billing operations are processed securely via Stripe:

• Diagnostic Credits: Purchasing a Basic or Elite Diagnostic Pass grants digital access tokens allowing a student to complete speech-based evaluation modules and generate detailed diagnostic reports.
• Verifiable Parental Consent Verification: Payment card processing via Stripe serves as a Tier 1 Verifiable Parental Consent mechanism under COPPA § 312.5.
• Price Revisions: We reserve the right to alter pass pricing or feature bundles at any time. Existing purchased credits remain valid according to the terms at purchase.

4. Refund & Digital Content Waiver Policy

Under the UK Consumer Contracts Regulations and international digital supply laws, purchasing digital content grants immediate access to software execution enclaves:

• Digital Supply Waiver: By purchasing a Diagnostic Pass and starting an assessment session, you explicitly request immediate performance of digital service delivery and acknowledge that you lose your statutory 14-day right of withdrawal once credit consumption has commenced.
• Unused Pass Refunds: If you purchase a pass and make zero diagnostic runs, you may request a full refund within 14 days of purchase by emailing support@cognis11.com.
• Technical Defect Remedies: If an unresolvable server fault prevents session completion or report generation, we will re-credit the diagnostic pass to your account upon verification.

5. Speech & Intellectual Property Usage

By deploying our verbal extraction system, you grant cognis11.com the technical license to process transient student audio streams strictly to perform real-time speech-to-text conversion and evaluate cognitive error taxonomies.

All question sets, diagnostic taxonomies (error codes W1 through W9), scoring algorithms, site design, and brand assets are the exclusive intellectual property of cognis11.com. Unauthorized scraping, automated harvesting, reverse engineering, or resale of test content is strictly prohibited.

6. Limitation of Liability & Disclaimer of Warranties

cognis11.com is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express, implied, or statutory.

• Service Availability: We do not guarantee uninterrupted, crash-free, or error-free site operation. Periodic maintenance, hosting updates, or network delays may occur.
• Data Telemetry: We are not liable for lost diagnostic reports or session interrupts resulting from user browser hardware failure, microphone disconnects, or local internet outages.
• Liability Cap: To the maximum extent permitted by applicable law, our total aggregate liability for any claims arising out of your use of the platform shall not exceed the total fees paid by you to cognis11.com in the twelve (12) months preceding the claim.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
